Hardrock Excavating employee admits to violating the federal Clean Water Act, agrees to testify against Lupo as part of plea deal

The Hardrock Excavating employee charged with violating the federal Clean Water Act for allegedly dumping oilfield waste into a Mahoning River tributary pleaded guilty last week, The Vindicator reports (See our July 29, 2013, blog post – "Attorney representing Hardrock Excavating LLC withdraws from the company's illegal dumping case"). In addition to agreeing to "testify for the prosecution against [company owner Ben] Lupo and Hardrock in a trial, if necessary," the employee said in his written plea agreement that Lupo ordered him to dump waste on 24 different nights.
