Defendant in $30 million royalties lawsuit removes case to federal court

On November 30, Total E&P USA (Total), one of the defendants in a $30 million oil and gas royalties lawsuit filed last month, removed the case to federal court. The case had originally been filed in the Columbiana County Court of Common Pleas, as reported last month in the Akron Beacon Journal. Total noticed removal of the case to the United States District Court for the Northern District of Ohio, Eastern Division. In its filing, Total argued that the federal district court has jurisdiction under the Class Action Fairness Act, 28 U.S.C. 1332(d). It also argued that the forum selection clause in the relevant oil and gas leases does not bar the company from removing the case to federal court.
