Athens County group intends to appeal injection well permit

The Athens County Fracking Action Network (ACFAN) has announced that it will appeal a well permit issued by the Ohio Department of Natural Resources (ODNR), reports The Athens News.  The permit, issued to West Virginia-based K&H Partners, allows for the drilling of an injection well off of U.S. Route 50 in Athens County.  

ODNR was quick to point out that the permit only allows for drilling and testing and that K&H must apply for another permit before it can open and operate the well.  ODNR also expressed its position that a permit to drill is not an appealable order.  In support of its position, ODNR cited R.C. 1509.06, which states that “the issuance of a permit shall not be considered an order by the chief,” and therefore cannot be appealed.

ACFAN counters that the Revised Code refers to production wells and not injection wells.  

This issue will continue to arise as local authorities try to control the drilling in their area.
