Property owner who lacks mineral rights bears the brunt of the shale boom

Despite owning the land on which the drilling rig responsible for the "biggest oil and gas find in Ohio's new energy boom" sits, Kenneth Buell receives nothing in royalties for the oil and gas, nor does he receive compensation for the land damage, because he does not own the mineral rights beneath his property, the Akron Beacon Journal reports. However, a judge's recent ruling that a "through and under" provision included in the deed of the Jewett Sportsmen & Farmers Club "prevents a horizontal bore to other properties" from being constructed on their property may help Buell receive compensation for his damaged land, the article said (See the March 14, 2012, blog "Harrison County judge says that Chesapeake cannot use mineral rights to drill under neighboring property").
