Judge dismisses Patriot Water Treatment vs. Ohio EPA case
|
The Ohio Environmental Protection Agency's request for dismissal in its case against Patriot Water Treatment LLC was granted due to "lack of subject matter jurisdiction" in the Trumbull County Court of Common Pleas on Friday, The Vindicator reports (Read the Mar 23, 2012 blog – "Commission rules against Ohio EPA's order that the city of Warren cease accepting brine water from Patriot"). Judge Andrew D. Logan found that the Environmental Review Appeals Commission, which is already set to review the renewable permits in question on April 24, 2012, is the "appropriate and exclusive jurisdiction for this dispute," according to the motion to dismiss.
